Through the “e-pen” service on the website www.e-pen.it, IMPRINT s.n.c. offers personalised goods for sale.
Conclusion of the agreement
Via the “e-pen” service, the customer notifies the supplier of the order for purchase of the selected products with an indication of the price. Sending of the order implies acceptance of these terms and conditions.
The "e-pen" service sends the customer a detailed order confirmation in an e-mail that also contains an “order number” to be used for the purposes of simplifying further correspondence.
IMPRINT s.n.c. gives the customer (professional or private individual) the entitlement to withdraw from the contract within 48 hours from sending of the order by fax or telegram. If payment has been made, the customer will be entitled to reimbursement of the entire amount via bank transfer. Only the bank charges required for return of the funds will be deducted.
Execution of the contract
Personalisation of the goods
Following receipt of the order and subject to the right to withdraw referred to in the above paragraph, Imprint s.n.c. will contact the customer to agree how the goods are to be personalised. The customer must approve the personalised graphic design in writing, and send it by fax.
Prices
All the prices of products shown on the Internet site do not include VAT. The customer only has to pay the amount shown on the order, inclusive of all the costs of personalising the goods and delivery costs.
Methods of payment
Bank transfer in advance, to be made at the same time as approval of the draft graphic design.
Promotional offers
If there is a promotion on a product, the user not only has to make the order and the payment (in full, by bank transfer in advance) but must also approve the graphic design before the date shown on the promotion.
Delivery
The purchased goods will be delivered by carriers selected by IMPRINT s.n.c.
Delivery times, starting from approval of the draft graphics and payment of the balance of the agreed price, will not exceed 30 days.
The customer must report any defects in the goods supplied (differences from the approved design, malfunctioning of the goods) within 7 days (failing which the claim will be invalid) from the date of consignment, by registered post sent to the address shown above.
After such deadline the articles will be considered to have been accepted.
IMPRINT s.n.c. will, at its own care and expense, collect the product in order to replace it. If, however, the object of the disputed order is not returned in the same condition in which it was received, i.e. in perfect condition, unused, with the original packaging and together with any instruction manuals, with no parts missing, but is returned even with a single one of the essential parts missing, IMPRINT s.n.c. will consider the purchase of such product to have been completed by the customer. The product will remain available for collection by the customer at the warehouse of IMPRINT s.n.c, on appointment.
IMPRINT s.n.c. reserves the right to charge the customer for any costs incurred for inspecting the product or shipment of the same, if it is found to be intact and functioning, in contrast to the statement made by the customer.
AFTERSALES ASSISTANCE
This service is provided directly by the manufacturers of the goods sold, via their customer service centres. The customer must contact them directly for any complaint, grievance, request for service or repair. Details of these service centres, if not included on the individual product sheets, will be provided by IMPRINT s.n.c., who will reply to the address info@e-pen.it.
CONSUMERS
The object of the present agreement is the “supply of clearly personalised goods” pursuant to art. 3 of the Italian legislative decree no. 185/99. Customers (i.e. natural persons acting for purposes unrelated to their professional activities) are informed that art. 5 subsection 3 of the Legislative Decree 185/99 expressly excludes the right of termination for such goods.
PRIVACY
Pursuant to the law no. 675 of 31 December 1996, IMPRINT snc informs its users that their personal details provided when signing the purchase order and/or completing the invoice are excluded from consent of the data subject as they are only collected and stored on the basis of fiscal obligations required by law, and in any event only for the purposes of enabling precise fulfilment of the obligations deriving from the purchase agreement to which the data subject is a party and/or to acquire the necessary contractual information which is only activated at the request of the user (art. 12, par. A and B, Law no. 675/96). In particular, we would point out that personal details supplied by our users are only kept in the archives of IMPRINT snc and the user may request their removal at any time via fax 080.409.91.26 or e-mail: info@e-pen.it.
